19 Objective of the Course: To learn about the Constitution, constitutional concepts, institutions and rules, the period before the 1982 Constitution and the Constitutional order of our country according to the 1982 Constitution. To learn the functions, purposes and values ??of constitutions and thus to act in accordance with these basic legal rules. To provide students with the knowledge and skills to measure and evaluate in professions in which they can use constitutional information.
20 Contribution of the Course to Professional Development To gain the ability to apply the theoretical knowledge learned in the courses in public institutions and enterprises suitable for the student's program.
21 Learning Outcomes:
1 To have knowledge about constitutional law and constitutions.;
2 To learn the functions of constitutions and the level of contribution to the social order as the basic rule of law.;
3 To learn the characteristics of constitutions that guarantee fundamental rights and freedoms and the constitutionalism movement.;
4 To have knowledge about the State and the form of the state according to our Constitution.;
5 To ensure that our Republic is learned by evaluating the qualities specified in our Constitution.;
6 To be able to have knowledge on the constitutional rules regarding the legislative, executive and judicial organs and the functioning of these organs.;
7 To be able to comment on the democratic development of the 1982 Constitution in accordance with our own structure.;
8 To be able to be successful in measuring and evaluating in career choice and career.;
22 Course Content:
Week Theoretical Practical
1 Transfer of the lesson plan, the importance of the course, the definition of the constitution, its scope, constitutionalism and other related terms, making and changing constitutions, types of constitutions, the concept of law and the definition, purpose and subject of constitutional law.
2 Constitution's being the fundamental principle of law, the superiority and bindingness of constitutions, the control of the unconstitutionality of laws (general information about political control, types and ways of control, constitutional jurisdiction models, types of decisions that can come out of the constitutional judiciary), Making and amending constitutions, provisions.
3 The state, the elements of the state, its origin, the state forms in terms of the use of sovereignty, the unitary state, the united state (Federation, confederation), the state forms in terms of the source of sovereignty (monarchic, theocratic, oligarchic and republic).
4 Political regimes (democratic, authoritarian and totalitarian regimes), Democracy, its definition, content, requirements (such as human rights, rule of law, multi-party political life in general, elections), types of democracy, popular sovereignty and national sovereignty concepts, democracy rule-of-law relations .
5 Political Parties and their functions. The phenomenon that makes sense of elections: multi-party political life, elections, electoral principles and electoral systems.
6 The content of the government system and its relation with the concept of political regime, systems of government: unity of powers and systems of separation of powers, parliamentary government systems, mixed government systems.
7 General information about the Turkish Constitutional order and its historical background (Turkish Constitutional Developments until 1982 Constitution and amendments to 1982 Constitution).
8 The structure and characteristics of the 1982 Constitution, similar and different aspects with the 1961 Constitution, the state order stipulated by the Constitution, the definition of the "Republic" according to the 1982 Constitution, its scope and its meaning and its comparison with democracy.
