19 Objective of the Course: To teach the emergence of Islamic law and its development, basic concepts and principles and to compare it with other legal systems.

21 Learning Outcomes:
1 To understand the basic concepts and principles in Islamic law;
2 To compare the Islamic legal system with other legal systems;
3 To explain the emergence and development processes of Islamic law;
4 To know the problematic issues and to make a comparison between the Islamic legal sects, in general terms;
5 To know the imams (leaders) of the sects, other jurists and their studies;
6 To comprehend the emergence of taqlid (follow) and fanaticism, and to analyze the their causes and results;
7 To understand the general general purpose of Fiqh;
8 To produce and interpret solutions to the current legal problems;
9 In theory, to evaluation about the present and the future of Islamic law;
10 To understand the concept of judgement and its types ;
22 Course Content:
Week Theoretical Practical
1 The concepts of Islamic law, fiqh and Sharia, and relationships between each other, and place of fiqh in the Islamic sciences
2 The systematic of Fiqh and its comparison with other legal systems
3 Fiqh of the characteristics, its divine and human dimension, finalist feature, its flexiblity, universality, its gradualism, its principle of convenience
4 The emergence of the science of Fiqh, the fiqh in the period of prophet Muhammad
5 The fiqh in the period of Sahaba and Tabi'een
6 The school of Iraq and Hijaz, and division of Ahl al- Ra’y – Ahl al-Hadith
7 The emergence of legal sects (Madhabs), the sect of Hanafi and Maliki
8 The madhab of Shafi’i ve Hanbeli, Zahiri, Caferi and other sects.
9 The spread of madhabs, and emergence of recession and taqlid in fiqh
10 The revival in Fiqh, Fıkhın yeniden uyanması, the idea of ijtihad and talfiq (mixing between madhabs).
11 The concepts of legislator and obligant and judgement, its types
12 The resources of Islamic judgements, basic and secondary resources
13 The concept of universal rule in Islamic Law and idea of maqasid
