19 Objective of the Course: Problems in Commercial matters during the course of arbitration will be examined with consedering arbitration award, case law and institution’s arbitration rules.
20 Contribution of the Course to Professional Development It is aimed to learn how to solve the dispute with methods other than state jurisdiction.
21 Learning Outcomes:
1 Significance of autonomy of the free will of the Parties in the arbitration process ;
2 Considering the differences between arbitration and other dispute resolutions methods;
3 Validity of arbitration agreements with case law ;
4 Comparative anlaysis between institution’s arbitration rules and International Arbitration Act;
5 Turkish Law practices about Conventions on Recognition and Enforcement of Foreign Arbitral Awards ;
6 Performing interim decision by arbitrators;
7 The way of preclusion in double exequator;
8 Considering the concept and qualification of principle of kompetenz-kompetenz;
9 Considering problems about annulment of arbitration award;
10 Discussing the significants matters about law applicable to subtances of disputes;
